Agriculture Land Registration Process in Tamil Nadu

Brief Summary of the documents that would be needed for Registration:

1. Mother Deed. (History Documents)
2. Chitta,
3. Adangal,
4. Patta
5. Encumbrance Certificate

Agricultural Land Registration process in Tamil Nadu - Checklist

1. Please check whether the Computer Patta/Patta book stands in the name of the seller.

2. If there is any entry in Encumbrance Certificate (it is advisable to take for an at least 31 years from the Sub Registrar's office) by way of sale to the present owner, then ask for the original sale deed and check about the genuineness of the sale/validity of the sale/competency of the sale.
Also,if there is any entry such as mortgage/mortgage by possession etc., the property should have been redeemed before the sale to you and the cancellation of those encumbrances should find a place in the encumbrance certificate.

3. If the present seller is the owner -if it is his/her inheritance, please go through the A REGISTER and check whether his/her name appears as the owner of the Survey Number/sub division.

(A REGISTER is a public documents which is available with the Village administrative officer, in the details of owners of the village land is given such as Survey Number, Sub division number, Patta No, The extent in Hectare, the Kist, etc are given. The village Water Bodies, Paths, Roads, Government lands, etc,., are also mentioned)

4.Check with the local people and Village Administrative officer whether the present seller is in absolute possession and enjoyment of the property.

5. In some cases there may be some transfer to Bhoodhan movement/to Government of Tamil Nadu which can be verified with the records with the Taluk Office and/or the Village Administrative officer.

6. Whether the land has been assigned to the present seller by the Government of Tamil Nadu and this can again be verified with the records at Taluk Office and/or Village Administrative officer. The terms and conditions can be verified with the Assignment order available with the Vendor.

7. There may be similar names of sellers in the village and it is always good to check the Nick name or caste name to check the Survey number etc., The best thing would be to get the piece of land identified by the seller himself in the presence of some people of the village.

8. Normally the officials at Taluk level and below take sufficient care while effecting the name transfer in the Patta by calling for the details of co-owners of the land.

9. LAST BUT NOT THE LEAST, even though the Patta may be in the name of a single person, it is advisable to get the signature of his/her sons and daughters (including the minors, for whom the vendor will sign, of course) to join while executing the sale deeds in your favor.

10. Apply for the Encumbrance certificate in your own name and you can check the records yourself at the registrar office by paying additional fees, if you feel that it is necessary.

11. PLEASE CHECK THE CREDENTIALS OF THE BROKERS/INTERMEDIARIES before entering into an agreement with them and parting with any money.
